Statute of Limitations for Medical Malpractice Cases in Georgia

According to section 9-3-71 of the Georgia Code, the typical statute of limitations for medical malpractice cases in the Peach State is two years. In most instances, the countdown timer begins on the day the victim sustained their injury or illness.

Georgia law makes a notable exception to this general rule for cases involving children, however. Since minors do not have the right to file lawsuits, their two-year timer does not start on the date they sustain their injury.
